The Receiver has filed his Fifth Report and Fourth Interim Agreed Application for Payment of Fees and Expenses. A copy of the Receiver's Fifth Report is available here.

The Receiver, in consultation with the FTC, has concluded that the most equitable and reasonable basis for distributing funds to former customers is to recognize only 629 claims of former customers who: (1) filed a Proof of Claim; and (2) paid monies to Kirkland Young in the form of a front-end and/or back-end fee, and; (2) who did not previously receive a distribution of their escrow funds earlier this year, pursuant to paragraph V.I.E.1 of the Court’s Final Order.   We encourage all former customer who filed a Proof of Claim to review the distribution list here for further updates regarding their particular claim.

Thank you,

Mark F. Raymond, Receiver
